Avukat Eyl\u00fcl Y\u0131lmaz Alt\u0131nda\u015f, yapt\u0131\u011f\u0131 a\u00e7\u0131klamada mevzuat\u0131n a\u00e7\u0131k h\u00fck\u00fcmlerine ra\u011fmen i\u015f\u00e7ilerin hak kay\u0131plar\u0131na u\u011frad\u0131\u011f\u0131n\u0131 belirterek uyar\u0131larda bulundu.<br>Fazla mesainin yasal s\u0131n\u0131r\u0131 270 saat<br>Alt\u0131nda\u015f, \u0130\u015f Kanunu\u2019nun haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresini 45 saat olarak belirledi\u011fini hat\u0131rlatarak, bu s\u0131n\u0131r\u0131n \u00fczerindeki \u00e7al\u0131\u015fmalar\u0131n fazla mesai say\u0131ld\u0131\u011f\u0131n\u0131 ve i\u015f\u00e7iye normal saatlik \u00fccretin y\u00fczde 50 fazlas\u0131n\u0131n \u00f6denmesi gerekti\u011fini ifade etti. Yarg\u0131tay\u2019\u0131n yerle\u015fik i\u00e7tihatlar\u0131na g\u00f6re i\u015f\u00e7inin imzas\u0131n\u0131 ta\u015f\u0131mayan bordrolar\u0131n kesin delil niteli\u011fi ta\u015f\u0131mad\u0131\u011f\u0131n\u0131 hat\u0131rlatan Alt\u0131nda\u015f, i\u015f\u00e7inin fiili \u00e7al\u0131\u015fmas\u0131n\u0131 ba\u015fka delillerle ispat edebilece\u011fini ifade etti.<br>Serbest zaman hakk\u0131 da ihlal ediliyor<br>\u0130\u015f Kanunu\u2019na g\u00f6re fazla mesai kar\u015f\u0131l\u0131\u011f\u0131nda \u00fccret \u00f6denmesinin esas oldu\u011funu, ancak i\u015f\u00e7inin talebi halinde serbest zaman kullan\u0131labilece\u011fini kaydeden Alt\u0131nda\u015f, uygulamada i\u015fverenlerin bu hakk\u0131 \u00e7o\u011fu kez tan\u0131mad\u0131\u011f\u0131n\u0131, hem \u00fccret \u00f6demedi\u011fini hem de serbest zaman kulland\u0131rmad\u0131\u011f\u0131n\u0131 s\u00f6yledi.<br>\u201cFazla mesai i\u015f\u00e7inin vazge\u00e7ilmez hakk\u0131d\u0131r\u201d<br>Alt\u0131nda\u015f, fazla mesai uygulamalar\u0131n\u0131n yaln\u0131zca \u0130\u015f Kanunu\u2019na de\u011fil, anayasal haklara da ayk\u0131r\u0131 sonu\u00e7lar do\u011furdu\u011funu belirterek, \u201c\u0130\u015f Kanunu\u2019nun 102. maddesi, fazla mesai y\u00fck\u00fcml\u00fcl\u00fcklerinin ihlali halinde i\u015fveren hakk\u0131nda idari para cezas\u0131 uygulanaca\u011f\u0131n\u0131 \u00f6ng\u00f6rmektedir.
